A mother's remarriage cannot, by itself, cost her custody of her child, Pakistan's Peshawar High Court rules
A boy in Kohat will stay in the settled home he knows. The Peshawar High Court has held that a mother's second marriage, on its own, is not a conclusive reason to take away her custody of her child — what governs is the child's welfare. Refusing a father's bid to move the nine-to-ten-year-old from his maternal family home, Justice Muhammad Naeem Anwar instead ordered a structured visitation plan through the family court at Lachi, so father and son can build their relationship gradually rather than by uprooting the boy. The judgment (2026 PHC 6764, decided 14 October) puts the principle plainly: custody follows the child's settled life and wellbeing, not assumptions about a parent's remarriage.
